EDR’s legal team recently handled a case against a software company (referred to as “the Opponent” or “the Customer”) that failed to fulfill its obligations to our client (“the Client”).
Upon receiving the case and thoroughly reviewing all pertinent documents, our team diligently attempted to establish contact with the Opponent through various channels. Unfortunately, our efforts to engage with the responsible individuals at the company were met with no responses. Consequently, our legal experts conducted exhaustive research into the Opponent’s company status, meticulously analyzing its financial performance over recent years.
The investigation revealed a concerning trend of declining income for the Customer over the past year, raising potential red flags. Despite the absence of explicit details on insolvency procedures, our team identified associated entities and discerned the Opponent’s intent to liquidate the company.
As a next step, EDR assisted the client in swiftly filing the creditor’s claims, maximizing the likelihood of recovering the owed debt. This approach ensured the client’s position to obtain the highest possible amount in this particular case.
